The Work Health and Safety Tribunal (the Tribunal), established under the Work Health and Safety Act 2020 (WHS Act) and is constituted by a Commissioner of the Industrial Relations Commission. The Tribunal assists in the resolution of certain workplace health and safety matters under Western Australia's work health and safety laws. 

Parties can apply for certain matters to be heard in relation to work health and safety at Western Australian workplaces under the WHS Act. This includes:

  • persons conducting a business or undertaking (PCBU)
  • employees
  • independent contractors
  • outworkers
  • apprentices or trainees
  • students
  • volunteers
  • unions
  • workplace health and safety representatives
  • members of workplace health and safety committees
  • the regulator.

An eligible person may apply to the Tribunal for review of:

  • a decision made by an inspector under section 82(3)of the WHS Act
  • a reviewable decision made by the regulator
  • a decision made, or taken to have been made, on an internal review.

It is recommended that you try to find out under which section of the WHS Act you may apply to the Tribunal.

Prosecutions continue to be dealt with in the Magistrates Court of Western Australia.
