Fatigue management for commercial vehicle drivers

A commercial vehicle driver has a duty to comply with the following requirements:

  • to drive in accordance with regulation 18D of the Work Health and Safety (General) Regulations 2022
  • to hold a current medical certificate that confirms their fitness to drive a commercial vehicle 
  • keep records. 

Workers who drive commercial vehicles also have general duties under the Work Health and Safety Act 2020 and the Work Health and Safety (General) Regulations 2022

These general duties include:

  • ensuring they follow the person in control of the business or undertaking's (PCBU) instructions
  • reporting for work rested and fit for duty
  • producing accurate records showing their work times, breaks from driving and non- work time.
