Demolition work means work to demolish or dismantle a structure or part of a structure that is load-bearing or otherwise related to the physical integrity of the structure, but does not include:
- the dismantling of formwork, falsework, scaffolding or other structures designed or used to provide support, access or containment during construction work, or
- the removal of power, light or telecommunication poles.
A structure is anything that is constructed, whether fixed or moveable, temporary or permanent, and includes buildings, sheds, towers, chimney stacks, silos and storage tanks.
Demolition work is a type of construction work. Therefore, when carrying out demolition work, the requirements relating to construction work must also be complied with.
A construction project is a project that involves construction work where five or more persons are, or are likely to be, working at the same time at a construction site. Demolition work is also ‘high risk construction work’ if it involves, among other things, demolition of an element of a structure that is load-bearing or otherwise related to the physical integrity of the structure.
A safe work method statement (SWMS) must be prepared before the high risk construction work starts. Under the Work Health and Safety (General) Regulations 2022, a demolition licence is often required to carry out demolition work.
Notification of demolition work
You need to notify the regulator of proposed Class 1 or 2 demolition work.
- Regulation 142F requires a person who wishes to do Class 1 demolition work or Class 2 demolition work in accordance with AS 2601 to notify the regulator at least 5 working days before the work is intended to begin.
- Regulation 142G requires a person who wishes to do Class 1 demolition work or Class 2 demolition work not in accordance with AS 2601 to apply, at least 10 working days before the work is intended to begin, to the regulator for approval to do the work.
- For demolition work involving the use of explosives, 15 working days’ notice is required. Demolition work involving explosives is not to begin unless approval has been provided by the regulator.
